SECTION C OF TERMS AND CONDITIONS OF WEBSITE AND SERVICES (STUDENTS)
C1. Application of Section C
C1.1 This Section C is applicable to Students only. Notwithstanding the aforesaid, this Section C shall include references to Users and Tutors. Students are required to read the terms and conditions in this Section C as are applicable to Students.
C1.2 Notwithstanding clause C1.1, Students are bound by the provisions of Section A (Section A – All Users-Terms And Conditions of Website and Services)
C1.3 The definitions set out in clause A1 of Section A shall apply to this Section C.
C2. TERMS AND CONDITIONS OF SERVICES
C2. Registration
C2.1 In order to utilise the Website, whether as a Student or Tutor, a person will require to be registered by us. Registration is within our sole discretion. Upon Registration, a User will be furnished with unique login details, which are not to be shared with any third party.
C2.2 No person who is not registered as envisaged in clause C2.1 shall be entitled to access the Website or use or provide the Services.
C3. The Services
C 3.1 The Services to be rendered by the Tutor are to Students in respect of the Curriculum.
C3.2 The Website shall enable Students to connect with Tutors through an online video facility.
C3.3 We do not provide the Services. The Services are provided by the Tutor appointed by the Student.
C3.4 Users are responsible for obtaining and paying for any equipment and Internet service necessary to access the Services.
C3.5 The Services shall be rendered as follows:
C3.5.1 A Student may book a lesson with a Tutor, through the Website.
C3.5.2 A Student will be able to select a Tutor from our database on the Website, in respect of the subject matter within the Curriculum required by the Student.
C3.5.3 A single lesson shall be of a duration of 60 (sixty) minutes, save that this may vary at the discretion of the Tutor.
C3.5.4 A student will be entitled to 3 (three) free lessons with any tutor over a period of 2 (two) calendar months.
C3.5.5 A Student may purchase, in advance, any number of lessons, provided that such lessons are utilised within a period of 12 (twelve) months, following payment, failing which the lessons shall be forfeited and we shall be entitled to retain the payment made and no refund shall be due to the Student.
C3.5.6 In the event that a Tutor fails to attend a lesson validly booked through the Website, and the Tutor has failed to cancel the lesson at least two hours prior to the commencement of the lesson, the Student shall be entitled to a full refund of the purchase price of the lesson; alternatively, at the election of the Student, a credit shall be passed in favour of the Student for use in an alternative lesson.
C3.5.7 Should the Tutor cancel a lesson at least two hours before commencement of the lesson, the Student shall reschedule the lesson with the Tutor and shall not be entitled to any refund nor any credit in order to book a lesson with another Tutor.
C3.5.8 Should a Student cancel a lesson validly booked with a Tutor on notice of less than one hour, or fail to attend a lesson, the Student shall forfeit any amount paid in respect of the lesson and the Tutor shall be paid accordingly.
C3.5.9 Should a Student cancel a lesson at least 1 (one) hour before commencement of the lesson, the Student shall reschedule the lesson with the Tutor, and the payment made by the Student in respect of that lesson shall be utilised in respect of the rescheduled lesson.
C3.5.10 A Student will only be able to book a lesson in the event that the Student has funds in credit with us sufficient to cover the cost of the lesson.
C3.6 Nothing in these Terms is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or us in terms of the CPA.
C3.7 These Terms are important and should be carefully noted as they contain provisions which, within the limits of the CPA, may limit our risk or liability, create risk or liability for you as a consumer, may compel you to indemnity us and serves as an acknowledgement by you of any fact.
C3.8 We are not able to confirm that each User is who that User claims to be. You agree and understand that you assume all risks when using the Website, including without limitation any and all of the risks associated with any online or offline interactions with other Users.
C3.9 When interacting with other Users, you should exercise caution and common sense to protect your personal safety and property. We are not responsible for the conduct, whether online or offline, of any User of the Website nor are we liable for any claim, injury, or damage arising from or in connection with your use of the Website.
C4. Students
C4.1 Upon registration, a Student is granted the right to access and use the Website and the Services strictly for non-commercial and personal purposes. Such rights may not be transferred or sub-licensed by a Student.
C4.2 Services are available only to and may only be used by individuals who are 18 (eighteen) years and older and who can form legally binding contracts under applicable law. Individuals under the age of 18 but not younger than the age of 10 (ten) may utilise the Services only in conjunction with and under the supervision of a parent or a legal guardian. The parent or the legal guardian shall at all times be responsible for any and all activities related to the use of the Services by the aforementioned individuals. For the purposes of these Terms, the parent or legal guardian shall be regarded as the Student.
C4.3 A Student may not inquire about the engagement of or engage Tutors to complete assignments, write papers, take quizzes, or otherwise do work on a Student’s behalf. Further, a Student shall not use the Services for any purpose that violates the academic honesty policy or other conduct policies of a Student’s school or similar academic institution.
C4.4 A Student:
C4.4.1 agrees to honour any commitments or arrangements made with a Tutor;
C4.4.2 agrees not to circumvent or manipulate the fee structure, the billing process, or fees owed to us or a Tutor; and
C4.4.3 agrees to act in good faith towards the Tutors.
C4.5 Students are responsible for selecting the Tutor suitable for that Student’s learning goals. Students should check each Tutor's credentials, education and experience, as well as reviews from other Students.
